Personal Injury News - Compensation Claim for Nurse Upheld

A nurse spoke of her "enormous relief" after the hospital she blamed for her crippling back injury condition which ended her career, failed to overturn her £400,000 damages award.

The nurse won the award after a ground breaking High Court case last October.

The judge ruled that the Local Healthcare NHS Trust in East London failed to make adequate health and safety precautions available to nurses to protect them when they had to lift patients.

The case was taken to the Court of Appeal by the health trust, claiming that the nurse's condition was caused by a combination of a fall at home and spinal problems unrelated to her role at the hospital.

The representatives for the trust went on to say that if the work involved had worsened the condition, it was only for a brief period in the hurses long career and as such, the compensation claim should be reduced.

The Judge residing over the case ruled that the trust was wholly liable for the personal injury suffered by the nurse as it was proven that the two incidents which caused Mrs Knott's condition happened happened while the nurse was at work.

Back Injury Causes Continual pain

On reflection after the case, the nurse said: "I hope this case will encourage the NHS to have more respect for it's employees."

The nurse never returned to the hospital to work after the back injury caused serious neurological problems which left the nurse in agony.
